Terms & Conditions

Terms & Conditions

Effective October 1, 2025


Scope of Work
The estimate applies solely to the items detailed in the associated proposal. Any additional work outside of this scope will be provided as a separate proposal and must be accepted before work begins. The Client is responsible for ensuring safe site access and notifying us of any special conditions or restrictions before work begins.
 

Additional Work & Proposals
Any modifications - including changes to materials, quantities, layout, or added services - will be issued as a separate proposal. Acceptance may be given in writing by email or text message confirmation, or by clicking the "Accept" button on the proposal document.
 

Site Conditions & Liability
Solution Driven Landscaping will contact DigSafe as required to mark public utilities before work begins.


The Client is responsible for identifying and clearly marking all private underground features such as irrigation systems, electric or invisible pet fences, and non-utility lines.


Solution Driven Landscaping is not liable for damage to unmarked or unknown items, nor for delays or damage caused by weather events, natural conditions, or unforeseen site obstructions such as ledge or buried debris.
 

Payment Terms 

  • Deposit: A 50% deposit is required for all projects exceeding $2,500. 
  • Balance: Final payment is due according to the terms stated on the invoice. 
  • Late Payments: Overdue balances are subject to a 1.5% monthly finance charge. Any legal or collection-related expenses incurred are the responsibility of the Client.
     

Service Calls & Repairs
Service visits are billed at a minimum of one (1) hour per crew member. Any repairs to irrigation systems or site features during seasonal openings or closings are not included in the estimate unless specified.
 

Estimate Validity
Estimates are valid for 30 days from the date issued. Pricing and availability may be adjusted if work is not approved within that timeframe.
 

Completion & Acceptance
Upon completion of the work, the Client has 14 days to notify us in writing of any concerns. If no notice is received within this period, the project is considered complete and accepted as-is.
 

Termination & Cancellation
If the project is canceled prior to mobilization, the Client will be responsible for any costs incurred up to that point. If work has already begun, cancellation fees may apply up to 50% of the contract total.


Severability
If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
 

Governing Law & Dispute Resolution
This agreement is governed by the laws of the Commonwealth of Massachusetts. Disputes not resolved through communication may proceed to small claims court.
 

Insurance & Indemnity
Solution Driven Landscaping is fully insured. The Client agrees to indemnify and hold harmless Solution Driven Landscaping from any third-party claims arising from conditions on the property or actions outside our control.

Lawns

Lawn Establishment Policy

No Warranty Coverage

Solution Driven Landscaping does not offer a warranty on seeded, hydroseeded, sod-installed lawns, or overseeding due to factors beyond our control. The success of lawn establishment depends heavily on client care, environmental conditions, and ongoing maintenance after installation.


What To Expect:

  • Seed & Hydroseed: Lawns may appear thin or patchy during the first growing season. Full establishment typically takes 1 to 3 seasons with continued overseeding and proper maintenance.
     
  • Aeration & Overseeding: Overseeding introduces new grass into existing turf. Germination and coverage will vary depending on soil condition, shade, existing turf density, and client care. Multiple seasons of overseeding may be needed for a fuller lawn.
     
  • Sod: Provides immediate coverage but requires diligent watering until roots establish. Sod may show stress if not watered consistently.
     

Client Responsibilities:

  • Watering: Watering 2 - 3 times daily for at least 2 - 3 weeks is critical to germination and root development.
     
  • Mowing: Delay mowing until grass (seeded, sod, or overseeded) reaches 3 - 4 inches in height.
     
  • Foot Traffic: Limit traffic on treated areas for 4 - 6 weeks after installation or overseeding.


  • Ongoing Care: Seasonal fertilization, mowing at proper heights, continued overseeding, and aeration are necessary to achieve a dense, healthy lawn. 


Important Notes:

  •  SDL does not guarantee seed germination, sod root establishment, overseeding coverage, or long-term lawn performance.
  • Environmental stressors such as drought, overwatering, pests, disease, excessive shade, and poor soil conditions are beyond SDL’s control.
  • SDL is committed to your lawn’s success and will provide care recommendations for watering, fertilization, and maintenance to support long-term results.

Plants

Plant Warranty

 Warranty Coverage

  • Trees and shrubs installed by our team are covered by a one-year warranty from the date of installation.
     
  • This warranty includes a one-time replacement of the plant material only (labor, removal, and delivery not included).
     
  • Replacements are performed during optimal planting periods:
    → May 1 – June 30
    → September 1 – October 31
    (Dates subject to weather, scheduling, and plant availability.)

 

What is Not Covered. This warranty does not cover:

  • Annuals, perennials, bulbs, ornamental grasses, and groundcovers.
     
  • Transplanted or relocated plants.
     
  • Plants installed outside of the warranty window (April 15 – October 15).
     
  • Plants not supported by a functioning automatic irrigation system.
     
  • Plants that fail due to: 
    • Under- or overwatering 
    • Drought, wind, flooding, or other extreme weather 
    • Pest infestation, animal damage, or disease 
    • Salt, ice melt, or mechanical damage 
    • Seasonal die-back (e.g., winter burn) that may recover with proper care

 

Customer Responsibilities

  • Follow watering and care instructions provided at installation. Failure to do so will void the warranty.
     
  • Maintain the account in good standing; the warranty is valid only if the original invoice is paid in full and on time.
     
  •  Warranty is void if instructions are not followed or plants are relocated.

 

Excluded Plant Species (No Warranty Coverage)

Due to their sensitivity to New England climate conditions or pest/disease susceptibility, the following species and cultivars are excluded from warranty coverage:

  • Shrubs & Ornamentals:
    Azaleas, Rhododendron, Mountain Laurel (Kalmia), Andromeda / Pieris, Boxwood (Buxus), Holly (Ilex), Butterfly Bush (Buddleja), Redbud (Cercis), Roses (Rosa), Bluebeard (Caryopteris), Ornamental Grasses
     
  • Trees:
    White Birch (Betula), Austrian Pine (Pinus nigra), Douglas Fir, Fraser Fir, Hemlock (Tsuga), Oak (Quercus), Leyland/False Cypress (Cupressus /Chamaecyparis)


 All landscape plant orders are accepted under these conditions. No other warranties, express or implied, shall apply. 

Snow

 Service Limitations & Liability

  • Snow plowing and ice control do not guarantee bare pavement. Slippery conditions may persist. Weather can change rapidly without notice.
     
  • SDL assumes no liability for naturally occurring icy/snow conditions.
     
  • The Client indemnifies SDL and its employees against all claims or damages -including injury or property loss - arising from the use of the property during or after snow services.

 

Site Preparation & Incidental Damages

  •  All moveable items must be removed prior to service. SDL is not responsible for damage to items left onsite.
     
  • Snow services may cause incidental damage to groundcover, fencing, lighting, curbs, pavement, gravel, vehicles, or other surfaces.
     
  • SDL is not responsible for displaced gravel, mailbox damage caused by municipal plows, or pre-existing pavement issues.
     

Pavement & Hidden Obstructions

  • Plowing involves pushing a steel blade; pre-existing defects may worsen.
     
  • The Client is responsible for identifying/protecting obstacles such as water shutoffs, sewer vents, and other hidden objects.

 

Indemnification

  • To the fullest extent permitted by law, the Client shall indemnify and hold harmless SDL, its owners, employees, and subcontractors from all claims of bodily injury or property damage arising from conditions on the Client’s premises.


Snow Stakes 

  • SDL will install stakes unless otherwise agreed. Client-provided stakes must be installed by Nov. 15.
  •  If stakes are absent or ground is frozen, SDL is not responsible for resulting damage.
  • Drivers may adjust stakes for proper snow storage.


Terms of Service

  •  Service Period: November 15 – April 1 (annual).
  •  Payment Terms: Net 10 days; 1.5% monthly finance charge on balances more than 30 days past due. Collection costs, including legal/court fees, are the Client’s responsibility.
  • Suspension of Service:  Services will not be performed if past-due balances exist.


Cancellation

  • Residential snow agreements may be cancelled with 30 days' written notice by registered mail or email. All services rendered prior to cancellation remain due and payable.
